Terms & Conditions of Sale

These Terms & Conditions (“Terms”) apply to all purchases of goods supplied by Glow Surfaces (“Glow Surfaces,” “we,” “our,” “us”). By placing an order, you (“the Customer,” “you”) agree to be bound by these Terms.

2. Definitions

· Goods: products supplied by Glow Surfaces including resin, aggregates, tools, and accessories.
· Contract: agreement formed once we accept your order.
· Consumer: an individual acting outside of a business.
· Business Customer: any person or company purchasing in the course of trade.

3. Orders

· Orders may be placed online, by phone, or in writing.
· A Contract is formed only when we issue confirmation of acceptance.
· All orders are subject to availability.

4. Prices & Payment

· Prices are listed in USD and exclude applicable sales tax unless stated.
· Delivery charges are added at checkout or agreed in writing.
· Payment is due in full at the time of order unless a trade account is agreed.
· For trade accounts, invoices are payable within agreed terms; late payments may incur finance charges as permitted under the Uniform Commercial Code (UCC) and applicable state law.

5. Delivery

· Delivery is curbside unless otherwise agreed.
· The Customer is responsible for providing clear access for vehicles.
· Risk passes upon delivery. Title passes only once full payment is received.
· Delivery times are estimates. We are not liable for delays caused by carriers, force majeure, or events beyond our control.

6. Inspection & Acceptance

· The Customer must inspect Goods upon delivery.
· Any shortages, damages, or defects must be reported within 48 hours.
· If no notice is given, Goods will be deemed accepted.

7. Returns & Cancellations

· Consumers: You have the right to cancel within 14 days of delivery under the Federal Trade Commission (FTC) Mail Order Rule. This does not apply to perishable or consumable items such as resin, aggregates, or custom blends.
· Business Customers: Returns are at our discretion. Non-stock or special-order items are non-returnable.
· To request a return, you must contact us before sending items back.

8. Warranty

· Goods are warranted to be free from material defects at delivery.
· Our Lifetime Warranty applies only where installation and maintenance conditions are met (see Warranty Policy).
· Warranty does not cover misuse, neglect, poor installation, or use with non-approved materials.

9. Liability

· Our total liability is limited to the value of the Goods supplied.
· We accept no liability for: loss of profit, business interruption, indirect/consequential loss, or damage caused by improper installation, third-party products, or environmental factors.
· Nothing in these Terms excludes liability for death, personal injury, or fraud.

10. Intellectual Property

All brochures, website content, images, and brand assets remain the property of Glow Surfaces and may not be reproduced without written consent.

11. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including strikes, extreme weather, transport disruption, or shortages of materials.

12. Governing Law

These Terms are governed by the laws of the State of Florida and the United States of America. Any disputes shall be subject to the exclusive jurisdiction of the courts of Florida, USA.
